    Terms and Conditions

    By purchasing through this website you agree to be bound by the Terms and Conditions laid out below.  These conditions do not affect your statutory rights as a Consumer.

    Definitions: 
    "Buyer" means the Consumer who buys or agrees to buy Goods on this website from Tiamostore. 
    ""Goods" means all products listed on the order and the order confirmation e-mail 
    "Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977 
    "Delivery" means the delivery of the Goods to the delivery address specified on the order. 
     
    Ordering
     
    Any order placed by the Buyer and accepted by Tiamostore is subject to the following terms and conditions unless specified in writing by Espresso Products.
     
    A confirmation of your order will be sent by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted by Tiamostore.
     
    TIamostore retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.

    If a product is out of stock when you place your order, we will contact you to let you know when we expect to be able to ship it. If a product is completely unavailable when you place your order, we will contact you to arrange an alternative replacement or refund of any monies paid.



    While every effort will be made to ensure that all items shown in our on-line product catalogue are in stock we offer no guarantee of availability and this electronic publication does not constitute an offer for sale.

    We will usually dispatch goods within 24hours. If we are unable to despatch your order within 4 working days, we will contact you by e-mail with an estimated despatch date and offer you the option of cancelling the order. We reserve the right not to accept an order.

    Please Note: Goods which are not held in stock by Tiamostore and are ordered and/or manufactured and/or modified specifically for the Buyer cannot be cancelled once the order has been accepted by Tiamostore

    Payment: 
    Full payment is required at the time the order is placed and Tiamostore will collect the payment from the debit/credit card details supplied unless otherwise agreed at time of order. 
    All Prices and charges on this site are in U.K. pounds and exclude any V.A.T payable at the prevailing rate.
     
    Risk and Ownership: 
    The Goods shall be at the Buyer's risk once delivery has taken place. The Buyer must take all reasonable care of the Goods.
    Should the Goods return to Tiamostore having been damaged while in the Buyer's care, the cost of such damage will be recovered from the Buyer. 
    Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place. 

    Limitations of Liability: 
    TIamostore total liability in regard to the performance of this contract shall be limited to the value of the Goods. 
    Tiamostore  shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance or non performance of this contract. 
    Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. 
    All contracts shall be governed by English Law. 
     
     




    Faulty Goods:

    Complaints relating to faulty Goods should be notified in writing within 7 days of the fault becoming apparent and should be addressed to:-  Customer Care Department, Tiamostore, Unit 23 Bellevue Enterprise Centre, Ivy Road, Aldershot, Hants., GU12 4QW

    In the rare event that Goods develop a fault, Tiamostore retains the right to have the Goods repaired or replaced at Tiamostore discretion, and any delivery costs associated with the exchange of faulty Goods will be met by Tiamostore

    Where Goods are reported as faulty later than seven days after delivery, we require photographic evidence of the fault. Where upon we shall make a decision:
    1 – To replace the item like for like.
    2 – Make an allowance for the final acceptance of goods.
    3 – Arrange for an independent inspection.
    4 – Refuse the claim.
    Or 5 – Refund the buyer upon receipt of the faulty item.
     
    If the goods returned or at the time of the inspection are found not  to be faulty but the result of fair wear and tear, negligence or wilful damage, Tiamostore retains the right to charge £75 for the inspection and to cover its costs. This charge will be taken from the debit/credit card used to purchase the Goods. The Buyer and Tiamostore shall both agree to be bound by the results/findings of the inspector. 

    Refunds:

    Refunds on Goods cancelled prior to dispatch will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 10 working days of that written notice. All refunds will be made onto the same card used to make the original purchase.

    Refunds for cancellations made after the order has been confirmed by email will incur a £30 administration charge.
     
    Please note cancellations can only be accepted if the Goods have not gone into production as goods ordered from the manufacturers on the Consumers behalf are classed as bespoke items.



    Refunds on Goods already delivered will take place as soon as possible following the return and inspection of such goods and in any case will not exceed a period of 15 working days following that return.

    Once checked and signed for all products/items are the responsibility of the purchaser, the purchaser must be over 18 years of age to complete transactions. This does not affect your statutory rights as a consumer. 

    Delivery is normally within 4 working days (UK Mainland) and is the responsibility of the purchaser once the order has been received by them. 

    As a company we make every effort to maintain stock levels but, as we introduce new items, we phase out some of the old ones. Inevitably stock levels of these items will fall.

CANCELLATIONS/REFUNDS

If an order needs to be cancelled please contact us by email or in writing.
If we are unable to fulfil an order we will contact you with an alternative or you may request to cancel the order. Refunds will be given at the discretion of the Company Management.

Returns Information
You may cancel your order with us within 7 working days of purchase as long as the products have not been used, are unopened, kept within original undamaged packaging and are in a resaleable condition.

All transport costs of bringing such products back to Espresso Products is of responsibility of the customer and therefore will be deducted from the original selling price upon refund.
 All Trademarks are the property of their rightful owners.
PRIVACY STATEMENT
Espresso Products does not sell, rent or give out personal details you submit  to any 3rd party. We may use your phone number, address or e-mail address to contact you about an order. Any personal details gathered from orders or enquiries (collected lawfully and in accordance with the Data Protection Act 1998) are kept safely on our computers.

We do not send random marketing e-mails to personal e-mail addresses (Spam) in accordance with the (Privacy & Electronic Communications Act passed into law 11 DEC 03).
Description of goods:
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order.
All sizes given are approximate and the Buyer(s) should satisfy themselves that the goods will fit the Buyer’s requirements.
Delivery:
 
A charge of £6.95 will apply to all orders to mainland UK, where the inc. VAT value of the order is less than £60
Espresso Products will deliver FREE to mainland UK all orders over £60.00  
(with the exception of following postcodes AB, DD, FK 18-21, IV, KW, PA above 19, PH above 7, PL, TQ and TR.)
Delivery is available to offshore islands and Europe – price on application.

Espresso Products use the Royal Mail or professional distribution companies to deliver all  goods.
 
The products the Buyer orders will be delivered to the address specified in the order unless otherwise agreed in writing by the Buyer and Espresso Products. Changes in delivery address details will require evidence of abode i.e. photographic ID, Utility Bill etc.
Goods will be deemed to have been delivered once delivered to the specified address as detailed above and Espresso Products will not be liable to the Buyer for non-delivery of the Products.
 Espresso Products does not need to satisfy itself that the person accepting delivery at the specified address is the Buyer (or authorised by the Buyer to accept delivery of the Goods).
Dates and times quoted for delivery are approximate only. The seller shall not be liable for any direct, indirect or consequential loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.
Generally, where an order contains more than one item, all items will be delivered at the same time once all items are available.
Where a delivery date has been agreed with our carrier but the Buyer is not present to receive the delivery, Espresso Products reserve the right to charge the Buyer a minimum of £45 to cover part of the cost of the failed delivery.
The Quantity or content of any consignment of Products as recorded by Espresso Products or it’s carriers upon its dispatch shall be conclusive evidence of the quantity or content received by the Buyer on delivery unless the Buyer can provide conclusive evidence proving the contrary.
Time for the delivery shall not be of the essence.
All Goods must be signed for. We are unable to deliver to unattended premises or outside of customer addresses unless otherwise agreed in writing with Espresso Products prior to delivery.

Deliveries made to business addresses will have the Buyers authority for anybody in the building to accept the goods on the customer’s behalf. Espresso Products will accept no responsibility once the goods have been signed for at the requested address.
Any Warranty/Guarantee offered with the Goods is only applicable for Mainland UK. Should a manufacturing defect occur when Goods are outside Mainland UK the Buyer is responsible for any transport costs incurred.
No liability whatsoever will be taken by ourselves or our chosen carrier when a clearly signed POD (Proof of Delivery) note has been obtained; the words “not checked” or “unexamined” (or words to the same effect) shall not render the company liable for any shortage or damage subsequently discovered.

If you are planning to return any items please inform us of what it is you will be returning with a note detailing the problems experienced.
Please be aware that post and packaging is not refundable, except where items have been returned because they are faulty or do not otherwise conform to your order.
We cannot be held responsible for goods that are returned to us that are lost in transit. If you are concerned, then we recommend that you send the goods by registered post and retain proof of posting.
